Many DWI Cases in North Texas May Be at Stake or Dismissed

A recent news article states that thousands of DWI convictions in North Texas may be dismissed after a forensic analyst of Texas Department of Public Safety was accused of perjury. Claims made by lawyers state that this analyst may have handled up to 15,000 blood-alcohol testing samples that are now considered questionable.

This issue was brought about after Dallas and Denton County attorneys notified defense lawyers regarding debatable evidence that may have been used to convict their clients in DWI cases that involved this specific analyst.

Research states that concern deals with the situation which occurred inside the Garland DPS Forensics Lab and whether this particular analyst gave contradictory testimony regarding a lab error that occurred years before when he mixed two different blood sample results.

The attorneys involved in these cases that have the potential to be tried say they have always questioned the credibility of this analyst. One lawyer involved in a DWI case states that he always knew something was wrong and adds, “We’d have a high test blood case, someone that looked perfect on the video and we knew there was some sort of error, but we could never point to a reason why that disconnect could be there.”

The analyst under investigation exercised his Fifth Amendment right to not testify. A hearing is to be held in Collin County.
