Liability For Hospital Galveston Inmate Deaths
Inmates face a variety of health challenges during their incarceration. According to Health Affairs, “In 2019, there were approximately ten million admissions to more than 3,000 US jails—facilities that had become increasingly deadly in the prior decades. Between 2000 and 2019, jail mortality rose by approximately 11 percent. Although incarceration is widely viewed as a health hazard, relationships between jail conditions and jail deaths are understudied.” Many factors could potentially contribute to inmate deaths.
- Inmate deaths are more likely when jails are overcrowded.
- Inmate deaths are more likely when jail staff are not properly trained.
- Inmate deaths are more likely at jails that lack air conditioning.
Depending on the facts of any case, a jail or private healthcare provider could be liable if an inmate dies in their care. Jails must provide all inmates with medical assistance for their health needs. This includes care for whatever chronic health conditions inmates have. Incarceration tends to exasperate many medical conditions. There are many ways in which a jail may have failed to properly care for an inmate.
- Jail officials may have denied an inmate’s request for care.
- Jail officials may have failed to get an inmate the medication that they needed.
- Jail officials may have delayed sending an inmate to the hospital.
- Jail officials may have ignored the signs an inmate required medical aid.
Inmate deaths are often highly preventable. They tent to occur when jail officials are indifferent to the medical needs that inmates have. In many situations, jail officials will assume that inmates are “faking” their illness. This can have deadly consequences. The family of any person that died in a Texas jail may have legal recourse through a civil claim.
