For instance, in Texas, heroin and cocaine are classified as Penalty Group 1 drugs.

If you’re convicted of knowingly delivering less than 1 gram of heroin or cocaine, which is a state jail felony, you may be punished by:

  • Up to 2 years imprisonment, and/or
  • Up to $10,000 in fines

For knowingly trafficking 4 to 200 grams, the penalties you could face include:

  • Up to 99 years in prison, and/or
  • Up to $10,000 in fines

The federal penalties for trafficking heroin or cocaine are different from the state’s.

Delivering 1 kilogram or more of a substance containing heroin or 5 kilograms or more of a substance containing cocaine can result in:

  • Up to 10 years imprisonment, and/or
  • Up to $10,000,000 in fines (if the defendant was an individual)

If the use of the drug resulted in serious bodily injury or death, the imprisonment term increases to 20 years to life.
